Introduction

As explained in our Terms of Use, Deliberize™ is an AI-powered platform designed specifically for assisting legal professionals in making assessments with regard to jury selection and deliberations, as well as overall case strategy such as witness selection or the question of whether to settle or litigate. Deliberize provides the capability to analyze mock trial videos and transcripts with AI-driven insights, track juror sentiment, and make data-driven decisions through our applications, websites, platforms, content, products, and services (individually and collectively, the “Services”). The Services are owned and operated by Deliberize LLC (“DELIBERIZE”, “Company”, “we,” “us,” “our,” or “Deliberize”). DELIBERIZE respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the website <www.deliberize.com> (our "Website" or the “Site”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On this Website.
  • In email, text, and other electronic messages between you and this Website.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Company or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Website.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Website. By accessing or using this Website, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Website. This includes the following information:

  • Information from which you may be personally identified, such as: name; telephone number or mobile phone number; email address; mailing address; age; business name or name of legal entity/organization; employer-related information such as your title and your employer’s name, address, and phone number; or Deliberize account name/number and associated login credentials (e.g., user name/ID and password/key) of a user account you create with us ("Personal Information").
  • Payment Information: Customers also provide Payment Information including at least one valid payment method. Payment Information refers to credit card numbers, debit card numbers, financial account numbers, transaction details, and additional forms of payment. Your Payment Information is never taken by us or transferred to us either through our Services or otherwise. Our employees and contractors never have access to it. At the point of payment, you are transferred to a secure page on the website of our payment gateway partners. Their pages may be branded to look like a page on our Services but are not controlled by us. They are regulated by stringent credit card privacy laws as well as the rules of Visa®, Mastercard®, American Express®, Discover®, etc.
  • Information about your internet connection, the equipment you use to access our Website, and usage details.
  • We collect this information:
  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies
  • Information You Provide to Us

The information we collect on or through our Website may include

  • Information that you provide to us, such as when you: register and create an account with us to become a Registered User or a Customer; request information from us via emails or forms that you fill out on our Website; contact us regarding a question, concern, or inquiry, such as when you make inquiries concerning our Services; sign up or request to be placed on our mailing or text/email/telephone marketing lists; upload User Content on or through our Website (see the description of User Content below); subscribe to our Services; or otherwise interact with the Services or our representatives. We may also ask you for information when you report a problem with our Website.
  • Contents of emails, text messages, instant messages, chat messages, or other messages you send to us, or phone calls you make to us;
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Website and of the fulfillment of your requests. You will be required to provide financial information when you register and create a Customer account through our Website. (See “Payment Information” above.)
  • Project and User Content Provided to Us by Registered Users or paid Customers

Information provided by Registered Users or Customers who create a user account with us may include the above information as well as the following information

Project: As explained in the Terms of Use, a Registered User or Customer may create a “Project” through the Website, wherein a Project relates to a court case, litigation matter, focus group, or similar. A Project is limited to a matter or docket number or the like. Only a Customer may upload User Content to the Project for analysis.

User Content: “User Content” is content that a Customer who meets the terms and conditions may upload to the Project for analysis; that is, User Content refers to content submitted to the Website by a Customer for analysis by Deliberize (e.g., audio/video or transcript), and is defined further in our Terms of Use.

DELIBERIZE Content: As explained in the Terms of Use, “DELIBERIZE Content” is content provided to a Customer by DELIBERIZE as part of the Services, wherein “DELIBERIZE content” may include analysis, reports, feedback, presentations, and the like. A Customer is permitted to store and use DELIBERIZE content in accordance with the Terms of Use.

Seat License: A Customer has the option, subject to the terms and conditions set forth in the Terms of Use including payment, purchase a “Seat License” which enables the Customer to share a case with another Registered User.

Project or User Content, as well as user account information, Seat License information, and DELIBERIZE Content, are kept secure by us and are not shared with any third parties other than our affiliates and service providers (and each of their and our respective licensees, successors, and assigns) solely for the purpose of providing and improving the Services.

Deliberize does not use any Customer data to train AI models. All data collected (e.g., video, audio, transcripts, analysis results) is utilized solely to provide the Deliberize Services back to the Customer, and not to improve or train our own AI systems. We do not feed Customer jury data into any machine learning training pipelines – including internal Deliberize models and third-party service provider models – without explicit permission. The purpose of processing the data is confined to the Customer’s project analysis, and once that is achieved, the data’s use is complete (aside from secure storage as needed for the Customer’s account records).

Notably, the third-party AI services we integrate (such as Microsoft Azure’s foundation models) likewise do not use and do not have permission to use Deliberize customer data to train their models. Project and User Content that Registered Users or Customers entrust to Deliberize is used only to provide such users with the Services, and not to train AI. Deliberize’s analytics are generated by pre-existing models that operate under strict data privacy assurances. Neither Deliberize nor our vendors will mine the Project or User Content to improve any AI model. This data will only be analyzed to produce the outputs needed to deliver the Services and nothing further.

By leveraging top-tier, security-focused vendors and adhering to industry best practices, Deliberize maintains a strong security posture. We treat all jury deliberation videos and transcripts as highly protected information. Every aspect of data handling – from storage to analysis – is engineered to prevent unauthorized access or misuse. Data encryption protocols are used when necessary. Our ongoing SOC 2 Type 1 accreditation process further demonstrates our dedication to continuous improvement in security compliance.

In summary, Deliberize’s data handling practices are designed to give Customers and their legal teams peace of mind: data flows are transparent and restricted to their intended purposes; Customer data remains under strict privacy protections at all times; and robust security measures, backed by industry certifications, are in place across our infrastructure. We will continue to refine these safeguards as our platform grows, ensuring that your confidential jury deliberation data stays private, secure, and solely used for your organization’s benefit.

Accordingly, User Content is only used for storage, transcription, and analysis – not for training any AI models. We only share User Content with third party service providers for the purposes of providing the Deliberize services; Deliberize uses a carefully controlled data pipeline that leverages trusted third-party services for specialized tasks. At each step, User Content is transmitted and stored securely, only for its intended purpose. Although our pipeline for processing User Content utilizes highly secure measures including, at various points, SOC-2 Type 1 and Type II accreditation, ISO 27001, PCI-DSS, HIPAA, FedRAMP compliances, and encryption protocols, please be aware that no security measures are perfect or impenetrable.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically may include personal information, and we may maintain such information or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Website according to your individual interests.

  • To market or re-market our products or services to you, by mail, telephone, e-mail, or text message (including by an automatic telephone dialing system) at any of the phone numbers or e-mails provided by you or on your behalf in connection with a DELIBERIZE account. You may opt out of receiving marketing messages from DELIBERIZE at any time by emailing legal@deliberize.com. You cannot, however, opt out of receiving emails relating to your account with us and/or our paid services, including receipts and purchase confirmations.   • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may also disclose your personal information:

Accessing and Correcting Your Information

If you are a Registered User or a Customer, you can review and change your personal information by logging into the Website and visiting your account profile page.

More generally, site users may send us an email at legal@deliberize.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your State Privacy Rights

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information's nature for processing purposes (excluding Iowa and Utah).
  • Data portability.
  • Opt-out of personal data processing for:
    • targeted advertising (excluding Iowa) [although we do not currently engage in targeted advertising];
    • sales [although we do not sell personal information, or share personal information with third parties other than service providers for the sole purpose of providing or improving our services, as described herein]; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah) [see just above].
  • Either limit (opt-out of) or require consent to process sensitive personal data [we do not sell or share sensitive personal information and any such information collected is used only to provide services to you].

Please note that the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
